Right to file a complaint if an American Indian is not in U.S. for last over 8 years.

Does an American Indian (LPR) loose right to file a complaint with State, Federal or any private agency if he is out of U.S. for last over four years against a private business company located in a State of U.S for non-rendering due services in time?
